I was filled with immense sadness today when my good friend, fellow patriot, and one of the bravest people I know, James Lane of OKC, called me and told me how he was beaten, falsely arrested, spent a night in jail and had his property stolen from him for simply video taping an altercation taking place between the officers and another patriot (they were engaging in nonviolent street action).

Just 2 days ago a local St. Louis Patriot was jailed for handing out fliers.

The FCC is shutting down patriot micro broadcasters all over the country, fining them 10s of thousands of dollars.

OKLAHOMA CITY – Two members of We Are Change Oklahoma claim they were brutally assaulted by mall security guards and an officer of the Oklahoma City Police Department and ultimately arrested on Friday afternoon during a non-violent “street action” at Penn Square Mall.

Red Dirt Report and Oklahoma Watchdog were given exclusive information by Oklahoma City resident and WAC-OK founder and activist James Lane who was just released from the Oklahoma County Jail arrested on charges of assault and battery.

“Even though I was the victim of the brutal, unprovoked assault, and never touched a single officer, I was charged with assault and battery,” Lane told Red Dirt Report on Sunday evening.

Lane along with fellow activist Brent Southard and a third activist decided to go to Penn Square Mall – owned by Indianapolis-based Simon Property Group – on the afternoon of “Black Friday,” the popular shopping day right after Thanksgiving.

Seeing Penn Square Mall as an optimal place to spread their information via “deception dollars,” which would be tossed from the second floor of the mall in the vicinity of the food court, they hoped to promote alternative media websites.

“There were eight of us initially,” Lane said of the protest which was designed to educate shoppers through the information on the fake money. “We (Lane and Southard) didn’t even throw the dollars.”

Gathering on the second floor, Lane was tasked with photographing the event while Southard held a bag of “deception dollars” and a third activist announced the action via his bullhorn. This got the attention of mall security who proceeded to first go after the bullhorn-toting third activist but then started going after Southard who held a bag which contained the “deception dollars.”

Lane said Southard fled the scene, exiting near the mall movie theater. It was outside that Southard was ultimately taken down by what Lane considered to be five unprofessional mall security guards.

Meanwhile, Lane said he is close behind his friend, videotaping the entire event as it unfolded. Right before Southard was taken down, he said he heard one guard yell at two other guards to “take ‘em down hard,” immediately prior to his arrest.

Lane said an OCPD officer arrived on foot to assist the guards. All the while, he is about 20 yards from Southard filming this. It is then that Lane said he was approached by three security guards who see him filming the scene. In what he considered to be a threatening manner, they inform Lane to “turn the video camera off.”

Lane said he informed a security guard named Rick Wisner that “the state of Oklahoma is a single consent state and that he can film anywhere and anyone he pleases.” Lane also informs Wisner that he is welcome to ask him to leave mall property but that if he touches him “it will be considered assault.”

This did not stop Wisner and three other security guards from allegedly attacking and assaulting Lane.

As Lane yells that he is being assaulted, he gets the attention of the OCPD officer, yelling to him that “these men are assaulting me.” Instead of intervening and stopping the attack by the guards, the officer allegedly then joins the attack, ordering him to “stop resisting.”

At this point, Lane said his face is pushed into a pile of wood chips on a grass berm, resulting in contusions on his forehead. The assaulting guards and officer allegedly punched Lane in the ribs and back, ordering him to stop resisting. The pressure on his back is so great that Lane said he could not breathe. As he struggles for breath, they allegedly threaten to mace him as well.

Telling one of the assailants to “give him some lung” (air), Lane is able to breathe again but is then handcuffed and arrested.

Sitting in the OCPD squad car, Lane and Southard endure two hours of “snide remarks and veiled threats,” allegedly calling the duo “terrorists” and “ACORN liberals.”

Lane said one of the mall security guards taunted Southard and allegedly said, “You’re going to jail for assault, not me.” Lane retorts that he will “see him in court.”

Lane and Southard were booked into Oklahoma County Jail in downtown Oklahoma City. The third activist that had been with Lane and Southard fled the mall unmolested.

Lane, now out of jail, is seeking legal help. Information about the WAC-OK legal defense fund can be found at their site – www.wearechangeoklahoma.org.

“Because I was videotaping their actions they brutally attacked me, filed false charges against me and tampered with evidence,” Lane said, adding that he was going to fight the charges.

As for Southard, he was charged with disorderly conduct and assault and battery. He was released as well.

Lane said that the issue regarding “tampered evidence” is that his camera was confiscated as he was taken down and not returned. The police claimed it was being held as evidence.

“I’m 36 years old and I’ve never even been arrested in my life. It was horrible,” Lane said. “We were in lockdown. The jail was on a 72 hour lockdown. Locked two to a cell with lights on and nothing to read or watch. Just sit and stare at the ceiling. Wearing an orange jumpsuit, the whole works.”

Due to the late hour of this report, Red Dirt Report and Oklahoma Watchdog were unable to get comments from Les Morris, public relations officer for the Simon Property Group, or the public information officer for the Oklahoma City Police Department. Updates will follow.

Patriots, if you are reading this, you know well the importance of being able to effectively spread the liberty message. With tyranny on the rise and individuality on the decline, many of our fellow Americans remain in a slumber of apathy and gluttony. Convinced that Anderson Cooper is anti-establishment and Glenn Beck will lead the revolution, the people are in constant need of an honest alternative to the state controlled propaganda-spouting mainstream media machine.

For years 90.1 FM in Austin has fulfilled this dire need. With Alex Jones and Katherine Albrecht in the afternoons and the radical and informative programming of the Rule of Law Radio Network during the evenings, the truth is abundantly available over the airwaves in Austin. Just as we do not take freedom for granted, we must not allow ourselves to take the availability of this message for granted either. The establishment is hard at work attempting to hinder our ability to connect with the people.

As you may well know, the FCC has been bringing heat on 90.1 for the past few years. Several patriots have remained steadfast, deciding to stand strong and remain vigilant at the cost of much personal sacrifice. They have sacrificed much in order for the community to have greater access to the truth and now they need our help.

They choose to remain defiant as they are well aware that we the people delegated only specific and limited powers to our servant federal government. Among these powers was the authority to regulate interstate commerce. With the inclusion of the Tenth Amendment, our founders enumerated the fact that those powers not delegated to the federal government, were left to the states respectively and to the people.

It then follows that since the 90.1 FM transmission does not cross state lines and is therefore not INTERstate commerce, THE FEDERAL GOVERNMENT, AND THEIR ROGUE FCC ENFORCERS, HAVE NO AUTHORITY WHATSOEVER OVER OUR LOCAL MICRO TRANSMISSION.

So when the FCC threatened our local truth deliverers with a $10,000 fine if they failed to cease transmitting, did the lay down? Did they allow our servant federal government to act outside of its legitimate authority once again?

NO! They stood strong in defense of Freedom and the Constitution and 90.1FM continues to broadcast to this day!

Let this be an inspiration my fellow freedom fighters. As the final arbiters in dealing with the question of constitutionality, we the people have the choice to ignore unwarranted authority, turn our backs on tyrannical government, and simply choose to be free. Of course taking this path is often met by retaliation and coercion, but fear not the wrath of thine enemy, for there is strength in numbers, there is strength in unity, and above all, there is strength in truth!

So I challenge you, if you truly believe in the principles of liberty and the value of defiance, stand tall with us here in Austin. Come to the aid of those who would sacrifice their own well being in order to provide truth to the community.

Activist Gustavo Rendon was just arrested for placing flyers regarding an eminent domain issue on cars parked on the public street. The arresting officer told him to take the flyers off the cars, Gustavo refused and was arrested. There were many witnesses to this event, including his wife, fellow church members and fellow activists that were collecting signatures regarding this issue at the time.

I called my city police station to find out if it is against the law to place flyers on a car and was told only if it was on a private property lot ie Walgreens or there was a sign nearby that said no soliciting.

So I called the police station he was booked at to find out the charge. I was transferred to booking, I spoke to the woman on duty, Cambell, she said he was booked for “illegal fixed advertisement” a “city ordinance”. She refused to give me the ordinance number, by repeating that it was a “city ordinance”; I told her I needed the number of the ordinance in order to look it up and she hung up on me. I called her back, she threatened to hang up on me because she did not know, I asked her if there was an ordinance number on the booking sheet, she said no. I then asked if she could transfer me to someone that would know the ordinance number; she transferred me to the arresting officer, Officer Soomro. The transfer was not accepted by his desk/voicemail, I got the message that he was not taking calls at this time. I called Cambell back again and apologized for calling again, explaining that officer Soomro was not taking calls at this time. She put me on hold for a real long time, she came back and gave me ordinance number 86220990, I thanked her.

I looked up the ordinance number – it doesn’t exist. So I called back my police station and asked them to look it up. I gave them both the number and the description of “illegal fixed advertisement” – they did not find any such ordinance number and had never heard of that charge. I explained the situation to the officer and he informed me that when someone is booked, the ordinance number and the charge code must be on the booking slip. He then suggested that I call my alderman or the city council tomorrow morning at 314-657-1844.

I called back the police station that arrested Gustavo and spoke with an officer, didn’t get name, he said that the ordinance number doesn’t have to be on the booking slip but the charge code does (wow, the same city, but they have different rules on booking, depending on which part of town you are in- unacceptable!). I asked to be transferred back to booking to get the charge code on the booking slip. Cambell answered this question by saying that she didn’t have time for this, asked me for my name and said that Gustavo could tell me when he got his one phone call. I told her that I am a concerned citizen and didn’t know Gustavo, she laughed, said she was busy booking prisoners and that I needed to call back later.

The number of the police station is 314.444.2500 – Please call and demand that Gustavo be released immediately, as well as these bogus charges be dropped immediately.

A veteran activist added – We have run into obstacles from the police in the past. Sometimes it’s clear that they are hostile to our effort to stop eminent domain abuse and other times they are just ignorant of our First Amendment rights.

In any event, in order to assert your rights, everyone should understand the difference between a political activity and a commercial enterprise.

Laws against commercial activity, like street vending or soliciting, do not directly relate to petitioning and expressions of political opinions, like pamphleteering. The latter are considered expressions of “core political speech” and as such enjoy greater constitutional protection.

If the police question your activities ask them what law or ordinance they think you are breaking and then ask them if that ordinance pertains to commercial activities or expression of core political speech. If they don’t know, politely suggest that they look it up and then come back later with the answer (while you go about your business).
